1. Acceptance of Terms
By accessing and using the website treedigitalhub.com and/or engaging the services of Tree Digital Hub LLC ("Tree Digital"), you agree to be bound by these Terms and Conditions. If you disagree with any part of these terms, you must not use our website or services.
2. Description of Services
Tree Digital provides digital marketing services including, but not limited to:
- Local, national, and international SEO
- Paid Social (advertising on Facebook, Instagram, TikTok, LinkedIn, and other platforms)
- AI Search Authority strategies
- Digital marketing consulting
- Content management and automation
Specific details of contracted services are set out in the individual service agreement signed between the parties.
3. Engagement and Payment
Services are formalized through the signing of a specific service agreement. Payment terms, fees, and commitment periods are established in that contract. In general:
- Payments are made monthly as agreed in the contract.
- Payments overdue by more than 15 days may result in service suspension.
- Contracts include a minimum commitment period as specified in the individual agreement.
- No refunds are issued for services already rendered.
4. Client Obligations
By engaging our services, the client agrees to:
- Provide truthful, complete, and up-to-date information about their business.
- Grant necessary access to platforms, accounts, and systems required to deliver the service.
- Respond within a reasonable timeframe to information requests and approvals.
- Not use Tree Digital's services for illegal or unethical activities.
- Maintain the confidentiality of strategies, reports, and documentation shared.
5. Results and Warranties
Tree Digital commits to applying best practices and its expertise to achieve the agreed objectives. However, we do not guarantee specific results in terms of rankings, traffic, or conversions, as these depend on external factors beyond our control, including search engine and advertising platform algorithms.
6. Intellectual Property
All content created by Tree Digital for the client (copy, strategies, designs, reports) becomes the property of the client once the corresponding fees have been paid, unless stated otherwise in the service contract. The content of the treedigitalhub.com website, including text, graphics, logos, and methodologies, is the exclusive property of Tree Digital and is protected by intellectual property laws.
7. Confidentiality
Both parties agree to maintain the confidentiality of all information exchanged within the scope of the business relationship. This confidentiality obligation will remain in effect for 3 years after the termination of the contract.
8. Limitation of Liability
Tree Digital shall not be liable for indirect, incidental, special, or consequential damages arising from the use or inability to use our services. Our total maximum liability to the client shall be limited to the amount paid for services in the 3 months prior to the event giving rise to the claim.
9. Service Cancellation
Either party may cancel the service contract with the notice period specified in the individual agreement. Tree Digital reserves the right to immediately cancel or suspend services if the client breaches these Terms or the specific service contract.
10. Governing Law and Jurisdiction
These Terms and Conditions are governed by the laws of the State of Texas, United States. For the resolution of any dispute, the parties submit to the jurisdiction of the competent courts of Dallas, Texas.
11. Modifications
Tree Digital reserves the right to modify these Terms and Conditions at any time. Changes will take effect upon publication on this website. Continued use of our services after modifications constitutes acceptance of the new terms.
